Europees Parlement publiceert studie over auteurscontractenrecht

In januari 2014 publiceerde het Europees Parlement een belangwekkende studie over het Auteurscontractenrecht: http://www.europarl.europa.eu/RegData/etudes/etudes/join/2014/493041/IPOL-JURI_ET(2014)493041_EN.pdf.

De twee belangrijkste conclusies luiden dat (1) de contractuele balans tussen maker en producent moet worden hersteld “authors agree on some reciprocal bargain for effective exploitation and fair remuneration should be counterpart of the transfer of copyright”;  (2) “copyright contracts should be adressed within the broader picture of the exploitation of creative content, which requires consideration of the articulation of such contracts with other contractual relationships ad exploitations undertaken by all stakeholders”.

Een belangrijke aanbeveling luidt: “Further research might be envisaged to study the impact of competition law on the admissibility of collective measures to enhance and secure fair remuneration for authors.”
